Widely opposed 'historic' land deal at site of  1990 Oka conflict is signed

OTTAWA (CP) - A land governance deal ratified by a margin of two votes
was signed Thursday for the territory where Mohawks stared down
Canadian Forces soldiers at Oka in 1990. Indian Affairs Minister
Robert Nault called the widely opposed deal a "historic" testament to
the merits of "negotiation over confrontation..........
{EXCERPTED}...His community ratified the agreement in October by 239 to 237 votes,  with 10 spoiled ballots. Fewer than half of about 1,000 eligible  voters turned out, reflecting opposition from traditionalists who
don't recognize the elected band council's authority.
"James Gabriel and his council can claim to work for Canada, not the   people of Kanesatake," said a statement released by Walter David on   behalf of Mohawk traditionalists.
"It is our opinion that the government of Canada is negotiating with
(itself), in that the present band council system in Canada is (the
government's) creation: by policy, funding and procedures."
By tradition, women are the titleholders of the territories and
custodians of the land, says the statement.
"No band council or individuals have the moral or ethical right to
negotiate instruments that will impact on our children, grandchildren
       and beyond."......READ THE ARTICLE...

Sculpture of Indian with scalp to be auctioned on History Channel
    Racist or art?

                          AP Regional - 12/21/2000
                            by KAREN MATTHEWS
                           Associated Press Writer

NEW YORK (AP) - It's an image that today would be considered gory as well as racist an Indian on horseback brandishing the scalp of a freshly killed enemy.
But in the early 1900s this bronze cast of Frederic Remington's ''The Scalp'' was presented annually to the Brooklyn public school with the best sports record.
On Friday it will be featured on The History Channel and then auctioned on eBay, with bids starting at $250,000.
Born in 1861, Remington was an illustrator, sculptor and journalist whose depictions of cowboys and Indians helped burnish the legend of the wild West. His artwork remains widely exhibited today, with pieces on display from the White House to the Metropolitan Museum of Art.
Experts said ''The Scalp'' must be seen in the context of its time.
Laura Foster, curator of the Frederic Remington Art Museum in Ogdensburg, N.Y., said Remington'scareer ''was based on the fascination of the Eastern public with the idea of the American frontier and the vanishing, nearly extinct species of the wild native American.''...

HEALTH: ICT: Confronting diabetes with tradition
It is difficult to refute the fact that change of diet (and lifestyle) has caused serious health problems for Native people. It shows up with a vengeance in diabetes, a killer and disabler of major proportions in Indian country. Diabetes is an enemy that must be confronted: with
traditional cultural knowledge, new scientific information, with encouragement and practical programming. Spirit and body need a lot of help...READ THE ARTICLE...

Religious organizations are exempt from landmark preservation laws and can raze and replace historic church buildings, the California Supreme Court ruled Thursday. The court, voting 4-3, upheld the
constitutionality of a 1994 state law which, it said, neither endorsed
religion nor provided improper state assistance.
